By accessing our Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

These Terms comply with the Electronic Communications and Transactions Act, 25 of 2002 (ECT Act), the Consumer Protection Act, 68 of 2008 (CPA), and all other applicable South African legislation.

2. Eligibility

To place an order on our Website, you must be 18 years of age or older and have legal capacity to enter into a binding agreement under South African law.

 

3. Customer Accounts

You may register a customer account on our Website. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. Please notify us immediately of any unauthorised access at info@kaggenthreads.co.za.

 

4. Our Products - Secondhand and Thrifted Items

All items sold on our store are pre-owned, secondhand, and thrifted. Please read product descriptions and condition disclosures carefully before purchasing.

We grade items as follows:

  • Excellent - Minimal signs of wear; near-new condition

  • Good - Normal signs of use; no significant damage

  • Fair - Visible wear consistent with age; any notable flaws are described and/or photographed

By placing an order, you acknowledge and accept the described condition of the item. Items that match their listed description and condition grade are not eligible for return on the basis of general wear or age.

 

5. Pricing

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices are subject to change without notice. The price displayed at the time your order is confirmed is the price you will be charged.

 

6. Orders and Contract Formation

Placing an order constitutes an offer to purchase. A binding agreement is only formed when we send you an order confirmation email. We reserve the right to cancel or reject any order where:

  • The item has already been sold or is no longer available

  • A pricing or description error has occurred

  • We are unable to verify your payment

  • The order appears fraudulent or abusive

If we cancel your order after payment, you will receive a full refund within 5-7 business days.

 

7. Payment

Payment is due in full at checkout. We accept payment via our secure third-party payment gateway PayFast. We do not store your card details at any point - all payment data is processed directly by the gateway.

By submitting payment, you confirm that you are the authorised account holder or have permission to use the payment method provided. All transactions are processed in ZAR.

 

8. Intellectual Property

All content on this Website, including text, photographs, logos, and graphics, is owned by or licensed to us and is protected by South African copyright law. You may not reproduce or use any content without our prior written consent.

 

9. Limitation of Liability

To the maximum extent permitted by South African law:

  • We are not liable for any indirect, incidental, or consequential loss arising from use of our Website or products

  • Our total liability for any claim shall not exceed the amount you paid for the relevant item(s)

  • We are not responsible for delays or failures caused by circumstances beyond our reasonable control

Nothing in these Terms limits your statutory rights under the Consumer Protection Act or any other applicable legislation.

 

10. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes will first be referred to good faith negotiation. If unresolved within 20 business days, disputes may be submitted to the jurisdiction of the South African courts or, by mutual agreement, to arbitration.

 

11. Changes to These Terms

We reserve the right to update these Terms at any time. The revised version will be published on this page with an updated effective date. Continued use of the Website after any update constitutes your acceptance of the revised Terms.
